1. Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and HephaTech ("we", "us", "our") governing your use of the GrowBit website at growbit.hephatech.in and the GrowBit mobile app (collectively, the "Service"). The agreement is formed under the Indian Contract Act, 1872 by your installation, sign-up, or continued use of the Service. If you do not agree, please uninstall the App and stop using the website.


2. Eligibility

You may use the Service only if you are at least 13 years of age. Users between 13 and 18 should use the Service under the supervision of a parent or legal guardian. You must be competent to contract under §11 of the Indian Contract Act, 1872.


3. What we provide

GrowBit is a habit-tracking app with gamification, optional AI coaching, mood tracking, and social accountability features. The Service includes:

  • Creating, scheduling, and tracking habits (yes/no, measurable, timed)
  • Streaks, XP, achievements, and an Identity stat tree
  • Mood and energy logging
  • Optional push reminders
  • Optional social features: follows, circles, pacts, accountability twins, leaderboards, activity feed
  • Optional AI Coach (premium): daily/weekly summaries and recommendations
  • Optional Google Drive backup of your local habit database

The core habit-tracking features are free. AI Coach, Identity, and certain social conveniences are part of GrowBit Premium — see §8.


4. Your account

  • You sign up with an email and password verified by OTP
  • You are responsible for keeping your password confidential. Notify us immediately at hello@hephatech.in if you suspect unauthorised access
  • You must provide accurate information. You may not impersonate another person, register multiple accounts to evade limits, or use the account in violation of these Terms
  • You may delete your account at any time from in-App Settings (or via DELETE /me in the API). Deletion is permanent and cascades across all linked records

5. Your obligations

You agree not to:

  • Use the Service in violation of any law, including the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • Submit a name, username, avatar, or any text (habit names, notes, mood notes) that is unlawful, obscene, defamatory, threatening, hateful, harassing, or that infringes a third party's rights
  • Reverse-engineer, decompile, scrape, or otherwise attempt to extract source code, data, or assets from the Service except as expressly permitted by law
  • Interfere with the security, availability, or integrity of the Service (denial-of-service attacks, automated abuse, malicious content, attempts to bypass rate limits)
  • Use the Service to harass another user, impersonate, or invade their privacy via the social features
  • Resell or sublicense access to the Service or any premium feature
  • Use the Service in a manner that puts unreasonable load on our infrastructure (e.g. automated batch logging beyond what a human reasonably does)

6. Social features

If you enable social features (follows, circles, pacts, accountability twin, activity feed), some of your information becomes visible to other users you have a relationship with. Specifically:

  • Followers and circle members can see your username, name, avatar, archetype, premium-status badge, and selected activity-feed events (achievements, level-ups, pact milestones, boss-battle defeats)
  • Pact members and your accountability twin can see your completion status on the shared habit on each day, but not the value, duration, or note
  • Email, password, mood/energy entries, individual habit notes, and subscription details are never shared

You can leave a circle, end a pact, or unfollow at any time. Activity-feed events you have already published cannot be retroactively deleted from another user's feed cache, but they will not be re-rendered going forward.


7. AI Coach

The AI Coach (premium) generates daily and weekly summaries, focus-habit suggestions, and burnout-risk assessments. We use Google Gemini as the underlying model. The prompt sent to Gemini contains aggregated habit metrics only — it does not contain your email, name, password, user ID, payment details, or any free-text notes you've added to habits or mood entries.

AI Coach output is informational, not medical or psychological advice. It is generated by a probabilistic model and may be incomplete, inconsistent, or wrong. Do not use the AI Coach to make medical, financial, legal, or significant life decisions. If you want professional advice, consult a qualified human.

You can opt out of AI Coach at any time in Settings; the rest of GrowBit works exactly the same without it.


8. Premium & payments

GrowBit Premium is sold via Google Play Billing. By subscribing, you agree to Google Play's terms in addition to these Terms.

  • Pricing is shown in Indian Rupees (INR) and is subject to GST as applicable. Google Play handles tax collection and remittance for our region
  • Auto-renewal: subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Cancellation must be done from your Google Play account, not from inside GrowBit
  • Refunds: refund requests are handled by Google Play under its policies. We will assist you with valid refund requests where reasonable. Your statutory rights under the Consumer Protection Act, 2019 are preserved and not limited by this clause
  • Free trial (if offered): converts to a paid subscription unless cancelled before the trial ends. The trial offer, length, and price are shown clearly at the point of subscription
  • Loss of premium features: if your subscription expires or is cancelled, premium-only features stop working. Your account, habits, logs, mood data, and free features remain unaffected
  • Receipts: GST-compliant receipts are issued for each successful payment. Receipts are retained for at least 8 years as required by Indian tax law

9. Intellectual property

The Service, the GrowBit name, the GrowBit logo, the design and source code of the App and website, the mechanic content (habit categories, archetype rules, achievement definitions), and the AI-generated coaching responses generated for you are the intellectual property of HephaTech or its licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international treaties.

You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial use. The data you input (habit names, notes, mood entries) belongs to you; we hold a non-exclusive licence to store, display, and process it solely to operate the Service for you.


10. Third-party services

The Service relies on Google Gemini (AI Coach), Google Play Billing (subscriptions), Google Sign-In (Drive backup only), Notifee + Firebase Cloud Messaging (push notifications), Sentry (crash reporting, currently disabled), and Vercel (website hosting). When you use the Service you also interact with those services on their terms. We do not control them and are not responsible for their conduct, but we have selected them after a reasonable review of their security and privacy practices.


11. Intermediary status

To the extent the Service hosts or transmits user-generated content (your username, habit names, social-feed events, pact participation), HephaTech qualifies as an intermediary under §2(1)(w) of the Information Technology Act, 2000 and is entitled to the safe-harbour protections under §79 of that Act. We will:

  • Publish, in our Privacy Policy and these Terms, the rules of conduct for users (§5 above)
  • Inform users that breach of these Terms may lead to access removal
  • Take down content within 36 hours of receipt of a lawful order or a report under the IT Rules, 2021
  • Preserve information and records as required by law for the periods prescribed

To report unlawful or violating content, contact our Grievance Officer (see Privacy Policy §17).


12. Disclaimers

The Service is provided "as is" and "as available". GrowBit is not a medical or psychological device. Habit tracking, mood logging, and AI Coach output are not substitutes for professional advice from a doctor, therapist, dietitian, or any other qualified specialist. If you are dealing with a mental-health concern, please reach out to a professional or to a helpline.

To the maximum extent permitted by Indian law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of malicious code.

Nothing in this section excludes or limits any statutory rights you have under the Consumer Protection Act, 2019 or any other Indian law that cannot lawfully be excluded.


13. Limitation of liability

To the maximum extent permitted by law, HephaTech and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of motivation, broken streaks, lost data, loss of profits, business, or goodwill — arising out of your use of the Service. Where liability cannot be excluded as a matter of law, our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us for premium in the 12 months preceding the claim, or (b) INR 1,000.


14. Indemnification

You agree to indemnify and hold HephaTech harmless from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or any rights of a third party, or (c) any content you submit, share, or transmit through the Service.


15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you are in breach of these Terms or are misusing the Service. You may stop using the Service at any time by uninstalling the App; you may delete your account permanently from in-App Settings. The provisions on intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination.


16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to §17 below, the courts at [Jurisdiction city], India have exclusive jurisdiction over any matter not resolved by arbitration.


17. Dispute resolution

Any dispute, controversy, or claim arising out of or relating to these Terms — including their breach, termination, or invalidity — will first be addressed by good-faith discussion. If unresolved within 30 days of written notice, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by HephaTech, in [Jurisdiction city], in English. The award is final and binding. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.


18. Changes

We may revise these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be flagged in-App for 30 days; for substantive changes that affect your rights, we will require you to re-consent on next launch.

This document is a good-faith draft prepared in line with the Indian Contract Act 1872, the Information Technology Act 2000, the Consumer Protection Act 2019, and the Arbitration and Conciliation Act 1996. We recommend obtaining independent legal advice before relying on it for production.
